Terms and Conditions (GTC) KSS

1. Subject of the contract
Subject of the contract is the issue of a swimming
course according to the booked course type (water
habituation, beginner's course, advanced course,
etc.).
The offer of the crocodile swimming school is non-binding. Misprints and errors
cannot be ruled out. All information are therefore subject to change. The prices
valid at the time of conclusion of contract apply. The number and dates of the
course days can be found in the current course program on our website
www.krokodil-schwimmschule.de. One lesson lasts 30 minutes (beginner) or 40
minutes (advanced / technique).

2. Registration
By signing the registration form at the time of first registration, the applicant
accepts the conditions of participation. The follow up courses are booked by
signature on the designed lists or alternatively by e-mail. Only by a written
confirmation from the crocodile swimming school is the contract legally valid.

3. Payment of the course fee
Upon registration, the course participant agrees to pay the course fee for minors
and their legal representative. The course fee must be paid in the amount of the
invoice amount within 14 days, at the latest however up to the respective beginning
of the course on the account indicated in the invoice. Only a timely receipt of
payment entitles to attend the course.

4. Resignation from the course
If the course participant can not attend the booked course for an important reason,
please inform us by E-Mail or post (by post or email). For cancellations up to 2
weeks (14 calendar days) before the beginning of the course, a management fee of
20 € will be charged for the expenses incurred. If you decide to cancel the
registration later than 14 days before teh course starts, the total course fee will
be charged. If the cancellation is sent by post, the date of the postmark is decisive.
The burden of proof on the timely receipt of the resignation lies with the course
participant, with minors their legal representative. A substitute participant will be
accepted before the course starts. If your child does not attend the course due to
any reasons the course fees cannot be refunded.

5. Fitness / Health
Upon conclusion of the contract, the parents confirm that the participant is healthy
and fit for swimming from a medical point of view. Please clarify this in case of
doubt with a doctor. The crocodile swimming school is not obligated to have the
sport fitness confirmed by a certificate. Course relevant physical and / or health
restrictions must be communicated to the course management. Participants with
infectious diseases are not allowed to attend the class.

6. Failure of course hours
In the case of cancelation of courses due to unpredictable reasons (for example,
technical defects or other mandatory unforeseen events), the participant is not
entitled to repayment of the course fee or claim for damages. The lesson will be
made on another date. In case of illness or urgent prevention of the trainer, the
crocodile swimming school is entitled to use a suitable representation without prior
notice
The crocodile swimming school is not obliged to refund the course fee for missed
course units or to make up for the missing course units. If the course is canceled by
the participant, a refund of the course fee is not possible.

7. Changes in course schedule

Short-term changes to the course times and course instructors as well as the
course location during the entire term of the contract are reserved and do not
entitle to withdraw from the contract. If the minimum number of participants is not
reached, the crocodile swimming school is entitled to withdraw from the contract.
An already paid course fee will be fully refunded.

8. Liability
The course participation is at your own responsibility. The crocodile swimming
school is liable only for damage caused by gross negligence or willful misconduct. For
damages caused by the participant, the participant is liable. Likewise, no liability is
accepted for any injury or damage suffered by the participant outside the
classroom. The legal guardians are responsible for the supervision before and after
class.
Liability for thefts in the premises of the swimming pool is excluded.

9. Supervisory duty
The swimming pool may only be entered in the presence of the course management.
The instructor's supervision obligation is limited to the scheduled course time of
the swimming course. Before and after the course, the crocodile swimming school
assumes no responsibility and liability for the participants. The parents or escorts
must accompany the children personally to the swimming pool and until the course
starts.
The children have to be picked up on time at the end of the course. It is not
possible to supervise the children before and after the end of the course time.

10. House rules
Each participant is subject to the house rules or hall rules of the respective pool
and has to follow the instructions of the teaching staff, which are necessary to
protect and safeguard the physical health of the participants, without exception. In
the case of gross violations of generally binding rules of conduct, course
participants, accompanying persons and / or guardians can be excluded from the
lesson without compensation claims.

11. Contact details / Privacy Policy
By providing the contact details and e-mail address, the applicant agrees to be
contacted by post, telephone or e-mail. The content can be revoked at any time in
writing.
According to the Federal Data Protection Act (BDSG), the crocodile swimming
school points out that your registration data will be stored in the EDP. There is no
transfer of the data to third parties.

12. Final provision
If parts of the terms and conditions are invalid or void, the remaining provisions
remain unaffected. In place of the ineffective or void provisions, the corresponding
law comes into force.
