Terms and conditions Krokodil-Schwimmschule

 

 

1. Subject of the contract

The subject of the contract is the provision of swimming courses depending on the type of course booked (toddlers, beginners’ course, follow-up course, advanced course, etc.). The precise course information like the timing, the exact dates, the price and the number of units can be found in the course offer sent to you. A course unit lasts 30 minutes. The range of courses offered by the Krokodil-Schwimmschule is subject to change. Misprints and errors cannot be ruled out. All information is therefore subject to change and only becomes binding upon confirmation of participation.


2. Registration, conclusion of the contract

By signing the registration form when registering for the first time, the person registering accepts these general terms and conditions. The contract only becomes legally binding with the written confirmation of registration, which is sent by email from the Krokodil-Schwimmschule. For course participants who are underage, registration and all other declarations to be made in connection with the contract must be made by a legal representative.


3. Follow-up courses

Classification into the subsequent course is carried out by the trainers at the Krokodil-Schwimmschule based on the level of performance they have determined. If possible, the course location and time will be retained for the follow-up course. The course participants, or their legal representatives for minors, will receive an email from the Krokodil-Schwimmschule with the opportunity to register for the follow-up course. After registering via email, the follow-up courses will be organized. The Krokodil-Schwimmschule will then communicate the course location and/or the new course time as well as the course fee by email in a registration confirmation. The contract for the follow-up course becomes legally binding if the course participant, or their legal representative in the case of minors, does not revoke their registration for the follow-up course within 14 days of receipt of the registration confirmation.


4. Equipment and gear

In order to ensure the quality of the swimming courses and the safety of the course participants, the necessary equipment for carrying out the respective swimming courses is carefully selected and offered to special discount prices to our stundents by the Krokodil-Schwimmschule. We work with specific articles from the brand MadWave. It is not allowed to use any other articles from other brands than those we decide. We only accept the usage of Aquasphere swimsuits.


5. Payment of the course fee

By registering to the courses of the Krokodil-Schwimmschule, the course participant, or their legal representative in the case of minors, is obligated to pay the course fee (will be provided in the course overview), as well as the onetime application fee of 35€ and the price for the crocodile book 20€. The full above-mentioned fees are due for payment to the account specified in the Krokodil-Schwimmschule within 14 days of receipt of the payment information, but no later than the start of the respective course. The one-time registration fee is intended solely to cover administrative costs, setup fees and investments in staff and customer acquisition. Only receipt of payment on time entitles you to participate in the course. The Krokodil-Schwimmschule is allowed to collect the course fee and the material costs on site if and to the extent that payment has not yet been made by the due date.


6. Fitness/health

By registering for a swimming course, the person registering confirms that the course participant is fit to swim. In case of doubt, the course participant or legal guardian must clarify this with a doctor themselves. The Krokodil-Schwimmschule is not obliged to have a certificate confirming fitness for sport. Any physical and/or health restrictions relevant to the course must be communicated to the course management. Course participants with contagious diseases are not allowed to take part in the course.

We would also like to expressly point out that the swimming course takes place without parents and therefore the ability to take part in the course without parents is required.


7. Withdrawal from the course

If the course participant cannot take part in the booked swimming course for an important reason, this must be communicated in advance by email. Irregular participation in the booked swimming course, termination of the swimming course or a temporary illness of the course participant does not exempt you from paying the full course fee. If you cancel up to 2 weeks (14 calendar days) before the start of the course, an administration fee of €20 will be charged for the costs incurred. If you cancel up to 1 week (7 calendar days) before the start of the course, cancellation fees amount to 50% of the course fee. If you cancel later, the entire course fee will be charged.

The course participant reserves the right to prove that the Krokodil-Schwimmschule suffered no damage or that the damage was significantly lower than the above flat rate. The burden of proof that the withdrawal was received in a timely manner lies with the course participant. The right to take part in the booked swimming course is only available to the registered course participant and is not transferable to third parties.


8. Cancellation of course units

If a lesson is being canceled for reasons beyond the control of the Krokodil-Schwimmschule (e.g. pool closures, technical defects or other compelling reasons, unforeseeable events, contact restrictions), as well as in the event of illness or if the course instructor is urgently unable to attend, the participant is not entitled to a refund of the course fee or to compensation. The course block is extended by the canceled course dates or individual course units are rescheduled for another date. Alternatively, the Krokodil-Schwimmschule reserves the right to offer a combination of refunding individual course hours and extending the block.

If the instructor is ill or is urgently unable to attend, the Krokodil-Schwimmschule is entitled to appoint a suitable replacement without prior notice.


9. Changes in the course schedule, failure to reach the minimum number of participants

Short-term changes to the course times and course instructors as well as the course location during the entire term of the contract can be agreed upon in consultation with the affected course participants. If the minimum number of participants calculated by the swimming school is not reached, the Krokodil-Schwimmschule is entitled to withdraw from the contract. Any course fees already paid will then be fully refunded.


10. Liability

Participation in the course is at your own risk. The Krokodil-Schwimmschule is always liable without limitation for damages resulting from injury to life, body or health that are based on a breach of duty for which the Krokodil-Schwimmschule is responsible. In addition, the Krokodil-Schwimmschule is always liable without limitation for damages if they are based on a grossly negligent or intentional breach of duty for which the Krokodil-Schwimmschule is responsible.

Furthermore, the Krokodil-Schwimmschule is only liable for simple negligence if an essential contractual obligation has been breached. In these cases, liability is limited to the damage that is typically foreseeable in the contract, whereby the term essential contractual obligations abstractly refer to those contractual obligations whose fulfillment makes the proper execution of the contract possible and on whose compliance the customer can regularly rely.

No liability is assumed for injuries or damage suffered by the course participant outside of the course. The legal guardians are responsible for supervision before and after the course. Accompanying course participants who stay in the relevant rooms during the Krokodil-Schwimmschule courses do so at their own risk. There is no insurance cover in this respect.


11.Behavior in the pool and course schedule

The house rules as well as the health and hygiene concept of the respective pool, any notices and other instructions from the Krokodil-Schwimmschule regarding the course must be retained. Entering the bathing area is only permitted under the supervision of the course leader. The course participants' companions ensure that the course participants do not go into the water before or after the swimming course.

The instructor's duty of supervision is limited to the scheduled time of the swimming course. The Krokodil-Schwimmschule assumes no responsibility or liability for the participants before the start or after the end of the course period. The children are to be picked up on time at the end of the course. It is not possible for the course instructor to supervise the children before and after the course begins.

Every course participant must, without exception, follow the instructions of the course instructors, which are necessary to protect and ensure the physical health of the course participants. In case of a repeated gross violation of generally binding rules of conduct, course participants, their companions and / or legal guardians can be excluded from lessons without any claim for compensation if a warning has previously been issued by the Krokodil-Schwimmschule.

 

12. Contact details/data protection

Personal data is collected, stored, processed and used to the extent necessary through electronic data processing (EDP) exclusively for the justification, content design or changes to the contract as well as for the purpose of processing course participation. The basis for this is the relevant data protection regulations of the Federal Data Protection Act (BDSG). The personal data that is provided to us when making a booking (e.g. names and contact details) will only be processed for correspondence with the respective course participant and only for the purpose for which the data was made available to us. Personal data will not be passed on to third parties unless there is a legal obligation to do so or there is the express consent of the respective course participant. To the extent that the Krokodil-Schwimmschule uses third-party services to carry out and process processing processes, the provisions of the Federal Data Protection Act are adhered to.

Personal data that has been provided to us via our website will only be stored until the purpose for which it was entrusted to us has been fulfilled. If commercial and tax retention periods must be observed, the duration of storage of certain data can be up to 10 years.

If a participant no longer agrees to the storage of personal data or if it has become incorrect, the Krokodil-Schwimmschule will, upon appropriate instructions, arrange for the data to be deleted, corrected or blocked within the framework of the legal provisions. Upon request, each course participant will receive free information about all personal data that the Krokodil-Schwimmschule has stored about them. If you have any questions about the collection, processing or use of personal data, for information, correction, blocking or deletion of data, every course participant can contact the Krokodil-Schwimmschule directly.


13.Temporary membership in the swimming club Die Alligators e.V.

By joining the Krokodil-Schwimmschule, the participant becomes a temporary member of the swimming club “Die Alligatoren e.V.” for the duration of their participation in the Krokodil-Schwimmschule courses. The membership fee to be paid there will be paid by the Krokodil-Schwimmschule for the period of the limited membership. By completing the registration process the temporary membership in the swimming club “die Alligatoren e.V.” will be declared and the club statues accepted.


14.Final provision

If parts of the General Terms and Conditions are ineffective or void, the remaining provisions remain unaffected. The statutory provisions apply instead of the ineffective or void provisions.
